Acceptance of Terms

By accessing or using https://www.kizuna.ca or any related services (collectively, the “Services”), you agree to follow these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use the Services.

Changes to Terms

We may change these Terms at any time. If you continue to use the Services after any changes, you accept the revised Terms. The “Last updated” date shows when we last revised the Terms.

Eligibility

You must be at least 18 years old to use the Services. Individuals under 18 are not allowed to use or register for the Services.

User Representations and Account Registration

When you use the Services, you confirm that all information provided during registration is accurate, current, and complete. You agree to keep your password confidential and are responsible for all activity under your account. We reserve the right to remove or change any username we consider inappropriate.

Intellectual Property Rights

We own or license all intellectual property rights in the Services. We grant you a limited, non-transferable license to use the Services and Content for personal, non-commercial purposes only. You must obtain our express written consent for any other use.

User Content and Submissions

When you submit content to us, you grant us a perpetual, royalty-free license to use, reproduce, and distribute that content for any purpose. You are responsible for any content you submit and must ensure it complies with these Terms and applicable laws.

Prohibited Activities

You must not engage in activities that violate these Terms, such as unauthorized data collection, infringement of intellectual property rights, or any form of harassment or harm to others.

Purchases and Payment

You agree to provide accurate and complete payment information and authorize us to charge your chosen payment method for purchases and any related fees. Sales tax will be added as required. All payments must be made in Canadian dollars. Prices may change at any time, and we reserve the right to correct any pricing errors, even after payment has been requested or received. We also reserve the right to refuse any order and to limit or cancel quantities purchased per person, household, or order at our discretion.

Returns and Exchanges

You may return or exchange new, unused products in their original packaging within 30 days of purchase, subject to a 30% restocking fee. Opened or used products, solar panels, generators, and special orders are not eligible for return or exchange. Customers are responsible for return shipping costs. To return an item:

1. Obtain a RMA Number by emailing support[at]kizuna.ca
2. Securely pack the item with proof of purchase

Price Match Policy

We aim to offer competitive pricing at Kizuna. If you find a lower price for an item in our shop from an eligible competitor, we will match it if certain conditions are met. To request a price match, email us at support[at]kizuna.ca with the competitor’s current price, and our team will verify the price and item eligibility.

The item must be priced at $100 or more before tax and be new and identical to the competitor’s product’s brand, model, size, colour, and quantity. You must provide proof of the lower price through a current advertisement, online listing, or official quote. Price matching applies to recognized Canadian retailers, both in-store and online. Additionally, the item must be in stock at both Kizuna and the competitor at the time of your request. Items on closeout, liquidation, or clearance are not eligible for price matching. The policy also does not apply to bundled items, and we reserve the right to exclude Amazon listings from price matching.

Privacy Policy

Our Privacy Policy governs your use of the Services, which you can find at Kizuna.ca/privacy. By using the Services, you consent to the collection and use of your data in accordance with our Privacy Policy.

Dispute Resolution and Governing Law

Canadian law governs these Terms. Any disputes related to these Terms or your use of the Services will be resolved exclusively in Canadian courts.

Limitation of Liability

We are not liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the Services.

Indemnification

You agree to indemnify our affiliates, officers, agents, partners, and employees against any loss, damage, liability, claim, or demand made by a third party due to your use of the Services. We reserve the right to take over the defence of any situation that requires indemnification at your expense.

Service Changes and Interruptions

We may modify, suspend, or discontinue the Services without notice. We are not responsible for any loss or difficulty caused by your inability to access or use the Services during any downtime.

Geographical Restrictions

Our Services are intended for use solely by individuals residing in Canada. By accessing or using the Services, you represent and warrant that you are located within Canada. We do not provide the Services to users outside of Canada and reserve the right to refuse access to or restrict the Services for any user not located in Canada.

Agreement and Severability

These Terms constitute the entire agreement between you and Kizuna Inc. regarding the use of the Services. If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
